In September 2006, the Bayat Foundation was registered in New Jersey as a non-profit and the organization applied for its 501 c 3 tax exempt status in the United States. It is designed to allow people who wanted to take part in the rebuilding efforts in Afghanistan through a proper mechanism that donors are comfortable with. This organization will not be controlled by the NGO that has been previously established in Afghanistan.
That Non Government Organization in Afghanistan is primarily funded by NON 501 c 3 Bayat Foundation funds.
The 501 c 3 Bayat Foundation in the United States is intended to be primarily funded by the general public and will be operated based on the rules and guidelines of a 501 C 3 pending organization.
Although both organizations share the same founder, Mr. Ehsan Bayat,
- The activities and financial assets of both organizations are completely separated. Each being held accountable for its own activities based on the rules and regulations of the country it operates in.
- Neither Foundation will have the same majority Board members assuring independence from each other. Further, the decisions of the 501 c 3 will not be based on the needs of the NGO. They will be independent and will be operated completely separate.
- The 501 c 3 organization will conduct regular Board meetings and funding reviews to ensure this separation is properly adhered to according the IRS rules and guidelines.
- The 501 c 3 Organization’s Board of Directors will not have a majority of family members by either blood relative, marriage to relative, or employee of the Founder.
